NJA Condemns UK Government’s Reversal on ICC Objection

The National Jewish Assembly (NJA) unequivocally condemns the UK government’s recent decision to abandon its objection to the International Criminal Court’s (ICC) jurisdiction over the ongoing Israel-Gaza conflict. This decision marks a regrettable and regressive departure from the UK’s long-standing foreign policy and aligns us against international allies such as the USA and Germany, who have rightly challenged the ICC’s biased treatment of Israel.

The ICC chief prosecutor’s case against Israel is both morally suspect and legally dubious. It undermines international law by equating the actions of terrorists with those of democratically elected leaders and by launching cases against nations with robust, independent, and fully functioning judicial systems. Israel’s courts have historically demonstrated their capability by trying and jailing the country’s most senior leaders and are currently investigating allegations of serious misconduct relating to the conflict. There is no reason to doubt Israel’s ability or willingness to conduct these investigations fairly.

Sadly, the ICC chief prosecutor has chosen not to allow Israel the opportunity to address these issues internally. While the UK government’s desire to uphold international law is commendable, this decision will not advance that goal. Instead, it undermines the principles of justice and fairness.

Moreover, the ICC’s actions do nothing to facilitate a ceasefire or progress toward peaceful coexistence. Lasting peace between Israelis and Palestinians can only be achieved through direct negotiations between the parties involved.

This decision is particularly disheartening as it comes amid other troubling signals from the UK government. Last week saw the resumption of UK funding to UNRWA despite significant unresolved concerns about the organisation. Additionally, there are increasing reports that the government may soon announce a suspension of arms sales to Israel—a nation that recently endured the deadliest attack on Jewish people since the Holocaust.

These cumulative actions suggest a significant shift in UK policy away from viewing Israel as a key ally. Such a shift would not only be a strategic error but also a profound moral failing. The NJA urges the UK government to urgently reconsider its stance and reaffirm its support for Israel’s right to self-defence and its role as a crucial ally.
